Cook County State’s Attorney’s Office Seeks Resolution in Markham Mayoral Race Dispute

In light of questions of his eligibility to assume elected office, the Cook County State’s Attorney’s Office has asked Markham mayoral candidate Roger Agpawa to furnish proof of his ability to serve should he be elected.

Under Illinois Municipal Code, 65 ILCS 5/3.1-10-5, Agwapa would not be eligible to take the oath of office for mayor as a result of having pleaded guilty to federal mail fraud in 1999. Absent new information – and having neither disputed or received a pardon from this conviction by the President of the United States – should Agwapa’s candidacy be successful and he take the oath, the Cook County State’s Attorney’s Office will file suit in circuit court seeking his immediate removal from office. Agwapa was notified by letter that he must provide the requested information on his eligibility for municipal office no later than close of business on March 31.
